Terms and Conditions

1. Scope and Provider
1.1 These Terms and Conditions (“Terms”) apply to all orders placed through our online store at the-boost-2.myshopify.com (“the Store”, “we”, “us”, “our”). By accessing or using the Store, you (“Customer”, “you”, “your”) agree to be bound by these Terms.

1.3 These Terms apply exclusively. Any deviating, conflicting, or supplementary terms of the Customer shall not become part of the contract unless we expressly agree to their applicability in writing.
2. Contract Formation
2.1 The product listings in our Store constitute non-binding invitations to the Customer to make an offer to purchase. They do not represent a binding offer on our part.
2.2 By clicking the “Place Order” button (or equivalent) and completing the checkout process, the Customer submits a binding offer to purchase the selected products at the stated prices.
2.3 We will acknowledge receipt of the Customer’s order by sending an automated email confirmation. This acknowledgement does not constitute acceptance of the offer.
2.4 The contract between the Customer and us is formed when we send an order confirmation email expressly confirming that we accept the order and that the goods have been dispatched or are being prepared for dispatch.
2.5 The contract language is English.
2.6 The contract text (order details) will be stored by us and sent to the Customer via email along with the order confirmation. The Customer is advised to save or print the order confirmation for their records.
3. Prices and Payment
3.1 All prices displayed in the Store are quoted in Euros (EUR) and include the applicable statutory value-added tax (VAT), where applicable.
3.2 The price valid at the time of the order shall apply. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.
3.3 We accept the following payment methods:

- Klarna
- Apple Pay
- Google Pay
3.4 Payment is due immediately upon placing the order. The order will only be processed once payment has been received in full.
3.5 If a payment is declined or reversed, we reserve the right to cancel the order and withhold shipment until the matter is resolved.
4. Delivery
4.1 We deliver to countries within the European Union (EU). If your delivery address is outside the EU, please contact us before placing an order to confirm availability.
4.2 The estimated delivery time is 10 to 20 business days from the date of order confirmation. Delivery times are estimates and not guaranteed. Delays may occur due to customs processing, high demand periods, or circumstances beyond our control.
4.3 We offer free shipping on all orders within the European Union. No additional shipping charges will be applied at checkout.
4.4 A tracking number will be provided to the Customer via email once the order has been dispatched. The Customer can use this tracking number to monitor the delivery status of their order.
4.5 The risk of accidental loss or damage to the goods passes to the Customer upon delivery. For consumers, “delivery” means the point at which the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the goods.
4.6 If delivery is not possible due to incorrect or incomplete address information provided by the Customer, the Customer shall bear any additional costs incurred for re-delivery.
5. Right of Withdrawal
5.1 If you are a consumer within the European Union, you have the right to withdraw from the contract within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU).
5.2 The withdrawal period shall expire 14 days after the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods.
5.3 To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement (e.g., a letter sent by post or email). You may use the model withdrawal form provided on our website, but it is not obligatory.
5.4 To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

6. Returns and Refunds
6.1 If the Customer exercises their right of withdrawal in accordance with Section 5, the following conditions apply to the return of goods:
6.2 The Customer shall return the goods to us without undue delay and in any event not later than 14 days from the day on which the Customer communicates their withdrawal from the contract. The deadline is met if the goods are sent back before the period of 14 days has expired.
6.3 The Customer shall bear the direct cost of returning the goods. We recommend using a trackable shipping method to ensure proof of return.
6.4 The goods must be returned in their original condition, unused, undamaged, and, where possible, in their original packaging. The Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
6.5 We shall reimburse all payments received from the Customer, including the costs of delivery (except for supplementary costs resulting from the Customer’s choice of a type of delivery other than the least expensive standard delivery), without undue delay and in any event not later than 14 days from the day on which we receive the returned goods or the Customer provides evidence of having sent back the goods, whichever is earlier.
6.6 The refund will be processed using the same payment method that the Customer used for the original transaction, unless the Customer has expressly agreed otherwise. In any event, the Customer will not incur any fees as a result of the refund.
6.7 We may withhold the refund until we have received the goods back or the Customer has supplied evidence of having sent back the goods, whichever is the earliest.
7. Warranty and Liability
7.1 The Customer’s statutory warranty rights apply in full. In accordance with the EU Consumer Sales Directive (Directive (EU) 2019/771), consumers are entitled to a legal guarantee of conformity of at least 2 years from the date of delivery for any defective goods.
7.2 If goods delivered are defective or do not conform to the contract, the Customer has the right to have the goods brought into conformity (through repair or replacement), to receive a proportionate reduction of the price, or to terminate the contract, in accordance with applicable EU consumer law.
7.3 During the first year after delivery, it shall be presumed that any lack of conformity which becomes apparent existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity. After the first year, the burden of proof may shift to the Customer, as permitted under applicable law.
7.4 To the maximum extent permitted by applicable law, our liability for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, is excluded. This limitation does not apply to damages resulting from injury to life, body, or health, or from intentional misconduct or gross negligence.
7.5 Our total liability for any claim arising out of or in connection with these Terms or the use of our Store shall not exceed the total amount paid by the Customer for the specific order giving rise to the claim.
7.6 Nothing in these Terms shall limit or exclude any liability that cannot be lawfully limited or excluded under applicable EU or national consumer protection law.
8. Intellectual Property
8.1 All content, materials, images, graphics, logos, trademarks, text, software, and other intellectual property displayed on the Store are the property of The Boost or its licensors and are protected by applicable intellectual property laws.
8.2 No content from the Store may be reproduced, distributed, modified, publicly displayed, or otherwise used without the prior written consent of The Boost, except for personal, non-commercial use as permitted by applicable law.
8.3 Product images shown in the Store are for illustrative purposes. While we strive to display colours and details accurately, we cannot guarantee that the Customer’s device will accurately display such colours or details. Minor variations do not constitute a defect.
9. Data Protection
9.1 We take the protection of your personal data seriously. For detailed information about how we collect, process, store, and protect your personal data in accordance with the EU General Data Protection Regulation (GDPR), please refer to our Privacy Policy page.
9.2 By using our Store and placing orders, you acknowledge that you have read and understood our Privacy Policy.
10. Governing Law and Dispute Resolution
10.1 These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.
10.2 Notwithstanding the foregoing, if the Customer is a consumer habitually resident in an EU Member State, the Customer shall also enjoy the protection afforded by the mandatory provisions of the consumer protection law of their country of residence, to the extent that such provisions offer more favourable protection than Polish law.
10.3 EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform (ODR) for consumers. You can access it at: https://ec.europa.eu/consumers/odr/
10.4 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by applicable law. 11. Severability
11.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of these Terms, which shall remain in full force and effect.
11.2 The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent of the parties and the economic purpose of the invalid provision.
